These Terms of Service ("Terms") govern your use of the Care Crew workforce management platform ("Platform") and related services provided by Care Crew ("we," "our," or "us").

Our Platform enables organizations to manage employee schedules, coordinate shifts, track timesheets, and streamline workforce operations. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Platform. These Terms form a legally binding agreement between you and Care Crew.

Acceptance of Terms

To use the Care Crew Platform, you must complete the registration process and create an account. By completing registration, you acknowledge that you have read, understood, and agree to comply with these Terms.

Your continued use of the Platform constitutes ongoing acceptance of these Terms and any updates we may make. If you disagree with any changes, you must discontinue use of our services.

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Care Crew, or between you and other Platform users.

Your Responsibilities

Account Management

  • Provide accurate, complete, and current registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access or security breaches
  • Keep your account information updated at all times
  • Do not share your login credentials with others

Acceptable Use

You agree not to:

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use false information or impersonate others
  • Interfere with or disrupt the Platform's operation
  • Violate applicable laws or regulations
  • Infringe on intellectual property rights
  • Use the Platform for fraudulent, harmful, or illegal purposes
  • Modify, copy, or distribute Platform content without permission

  • Maintain Platform functionality and performance
  • Implement appropriate security measures to protect your data
  • Provide technical support and customer service
  • Regularly update and improve our services
  • Ensure compliance with applicable privacy and data protection laws

While we strive for continuous availability, the Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Payment and Subscription Terms

Subscription fees are billed in advance on a monthly or annual basis. You are responsible for all charges incurred during your subscription period.

Cancellation Policy

  • You may cancel your subscription at any time
  • No refunds are provided for partial billing periods
  • Access to services continues until the end of your paid period
  • Outstanding charges remain due upon cancellation
Data and Privacy

We are committed to protecting your data and maintaining your privacy. Our data handling practices are detailed in our Privacy Policy, which forms part of these Terms.

You agree to:

Intellectual Property

Care Crew owns or licenses all content, software, and materials on the Platform, including:

  • Platform design, functionality, and user interface
  • Software code and technical infrastructure
  • Trademarks, logos, and brand elements
  • Documentation and training materials

You retain ownership of your data and content. By using our Platform, you grant us a limited license to process and store your data to provide our services.

Termination

Your right to use the Platform continues until terminated by either party:

  • You may terminate by closing your account
  • We may terminate for Terms violations or business reasons
  • Termination ends your access to Platform services
  • Data retention policies apply after termination
Limitation of Liability

To the maximum extent permitted by Victorian law, Care Crew shall not be liable for:

  • Indirect, consequential, or special damages
  • Loss of profits, revenue, or business opportunities
  • Data loss or corruption
  • Service interruptions or downtime
  • Third-party actions or content

Our total liability is limited to the amount paid by you in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded under Victorian consumer law.

Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the jurisdiction of the courts of Victoria for any disputes arising from these Terms.

If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to achieve validity.
